What is a Restricted “Work” Licence Application?
If you have committed a drink or drug driving offence, a Magistrate can order a Restricted “Work” Licence be issued to you to allow you to drive in specific circumstances directly connected with your means of earning your livelihood. Your work licence will normally include conditions such as the class of vehicle, the purpose and the times at which a vehicle may be driven.
In order for a Magistrate to be able to consider whether to issue you with the Restricted “Work” Licence an application must be filed with your local Magistrates Court registry, accompanied by an affidavit by you stepping out why you need your licence to continue to work, and another affidavit from your employer (if you’re not self-employed) explaining that they would not be able to employ you if you were to lose your driver licence.

When should you complete these documents for the Restricted “Work” Licence Application?
An application for a Restricted “Work” Licence can only be made if you have not yet pleaded guilty to the offence which will cause you to lose your driver licence.
Generally speaking, you will be given a Notice to Appear by police for the offence which will cause you to lose your driver licence. That notice will tell you the date you are required to appear in court. On that date you can inform the court that you intend to make an application for Restricted “Work” Licence. A hearing date for the application will then be allocated. You should ensure your documents are ready to be filed with the court registry before your first appearance in court, although they may be able to filed at a later day, so long as they are filed prior to the date listed for hearing of the application.

Approximately 15 to 30 minutes.
Please note that you can exit the interview and come back to it at a later time, so long as you pick up the interview on the same device on which you started it.
What will you get?
Once you complete the online interview, your affidavits (yours and your employers) along with the details required to complete the application form will be sent to one of our traffic lawyers for review (up to 1 hour of review time is packaged into the $299.00 fee).
Once reviewed, those two affidavits (or one if you are self-employed) and an application form will then be emailed to your nominated email within 2 business days of our office receiving notification that you have completed the online interview.
If you decide after purchasing this package that you also require a lawyer to prepare and appear on your behalf at the hearing of the application before a court there is an additional fee for this additional service. The additional fee must be paid in full prior to any hearing date, and the terms and conditions for that service will be communicated to you at the time you request the additional service. Alternatively, you may wish to consider purchasing our “Prepared Documents and Court Appearance” Package for $1,815.00.
