Do I have to go to court?

If you have received a notice to appear or summons to appear in court you must go to court on that date listed in the notice, even if you have a lawyer. Failure to appear is likely to result in an arrest warrant being issued.

What do I need to provide for an initial conference?

You should bring any documentation or notice that has been provided by police or any other authority in relation to the charge. When you arrange your initial conference you will be advised of what you need to bring with you. 

How do I engage a lawyer?

The best way to engage a lawyer is to book an initial conference as soon as possible prior to your court date. At this initial conference a lawyer can better explain the charge and how the police and the court will deal with that type of charge, how long it may take, and how much it is likely to cost, depending on the type of offence and how you wish to plead. The lawyer will then advise the police and the court that they are your representative in the matter. 

How much is it going to cost to see a lawyer?

The cost of an initial conference with a competent and experienced lawyer will vary. At Nyst Legal we request an upfront deposit of $250 towards the cost of your initial conference. The seriousness of the charge will determine who will represent you and what work needs to be completed to prepare for your first court appearance. You should ask your lawyer for a broad estimate of your likely cost exposure at an early stage in order to anticipate and manage your finances. 

How long will an initial conference take?

Generally an initial conference can take up to an hour and for more complex matters it may take longer than that. It is important that you allocate sufficient time to discuss your matter in full and allow your lawyer time to outline the best options available to you.
